The Successor Trustee under the terms of the Trust Deed and Promissory Note described herein, at the direction of the Beneficiary, hereby gives notice of sale, default, and elects to sell the property described in the Trust Deed to satisfy the obligations secured thereby. 3. RECORDING: The Trust Deed was recorded as follows: Dated: May 24, 2019, Date Recorded: May 29, 2019, Instrument No.: 2019-014468, Jackson County.
4. DEFAULT: The Grantor(s) are in default and the Beneficiary has declared all sums due pursuant to the terms of the Promissory Note dated May 24, 2019, in the original amount of one million two hundred twenty-five thousand dollars ($1,225,000.00) plus interest thereon at the rate of 10.5% per annum, in the monthly principal and interest installments of not less than $10,718.75 for 22 consecutive payments, beginning on July 1, 2019, subject to a default rate of interest of 18.5% per annum and subject to a postmaturity rate of interest of 8%, the original of which is incorporated into the Trust Deed by reference, the entire balance of which is presently due and owing and the Beneficiary and Successor Trustee have elected to foreclose the Trust Deed including, but not limited to, the following: 1. Failure to make principal installment payments; 2. Failure to interest installment payments; 3. Failure to pay late fees; and 4. Failure to pay default interest and costs.
5. AMOUNT DUE: By reason of the Default just described, the Beneficiary has declared and does hereby does declare all sums owing on the obligations secured by the Trust Deed immediately due and payable, those sums being the following: principal in the amount of one million two hundred twenty-five thousand dollars ($1,225,000.00) plus interest thereon at the rate of 10.5% per annum, in the monthly principal and interest installments of not less than $10,718.75 for 22 consecutive payments, beginning on July 1, 2019, subject to a default rate of interest of 18.5% per annum and subject to a postmaturity rate of interest of 8% (or the maximum extent allowed by law whichever is less); title expenses; insurance; costs; trustee fees; attorney fees; and any other cost advances made by the Beneficiary to protect their interest in the said real property pursuant to the terms of the Trust Deed, including but not limited to attorney fees and costs incurred in defending and protecting the Beneficiary's interest in the Property against claims by third parties. Please note that the amounts stated herein are subject to confirmation and review and are likely to change in the next 30 days. Please contact the Successor Trustee to obtain a payoff quote prior to remitting funds.
6. ELECTION TO SELL: The Successor Trustee hereby elects to sell the Property at the time, place, and location listed below by public auction to the highest bidder in the form of cash equivalent (certified funds or cashier's check) the interest in Property which the Grantor(s) had or had power to convey at the time it executed the Trust Deed, together with any interest which the Grantor(s) or its successors in interest acquired after the execution of the Trust Deed, to satisfy the obligations thereby secured and the costs and expenses of sale, including reasonable charge by the Successor Trustee and costs and fees permitted under the Trust Deed.

8. RIGHT TO REINSTATE: The right exists under ORS 86.778 to have the proceeding dismissed and the Trust Deed reinstated by paying the entire amount then due, together with costs, trustee's fees, and attorney fees, and by curing any other default complained of in the Notice of Default, at any time that is not later than five days before the date last set for the sale.
9. STATUTORY NOTICE: Without limiting the trustee's disclaimer of representations or warranties, Oregon Law requires the trustee to state in this notice that some residential property sold at a trustee's sale may have been used in manufacturing methamphetamines, the chemical components of which are known to be toxic. Prospective purchases of residential property should be aware of this potential danger before deciding to place a bid for this property at the trustee's sale.
10. DEBT COLLECTION NOTICE TO CAROL A. DAVIS AND LUIS J. JAUREGUI, JR. AND PENNY C. JAUREGUI OF THE P.C.J. LIVING TRUST (GRANTORS): Grantors owe creditor, Beneficiary, the amounts described above pursuant to the Trust Deed and Promissory Note described above. Unless Grantors notify the undersigned Successor Trustee within thirty (30) days after receipt of this notice that the validity of this debt, or any portion of it, is disputed, Beneficiary and the Successor Trustee will assume that the debt is valid. If Grantors send the Successor Trustee written notice within 30 days that Grantor disputes this debt, or any portion thereof, the Successor Trustee will obtain verification of the debt and mail it to Grantors. Also, upon Grantors' request within thirty (30) days, the Successor Trustee will provide you with the name and address of the original creditor, if different from the current creditor. This notice is an attempt to collect a debt any information obtained will be used for that purpose.
11. MISCELLANEOUS: Other than as shown of record, neither Beneficiary nor Successor Trustee have any actual notice of any person having or claiming to have lien upon or interest in the Property described above subsequent to the interest in the Trust Deed, or of any successor(s) in interest to the grantors of any lessee of other person in possession of or occupying the Property, except: a. Clearinghouse Community Development Financial Institution, as noted in the Deed of Reconveyance: Dated: September 29, 2023, Date Recorded: October 2, 2023, Instrument No.: 2023-020832, Jackson County.
