To: All unknown descendants of John Roland Helman and Mary Jane Helman, deceased; and all other unknown persons or parties claiming any right, title, lien, or interest in the property described in this complaint herein., Defendants. YOU ARE HEREBY required to appear and defend Plaintiff's Complaint for Declaratory Judgment (ORS 28.010 et seq.) and Quiet Title (ORS 105.605)(Not Subject to Mandatory Arbitration)(No Monetary Relief Sought) filed against you in the above entitled action, within thirty days (30) from the date of first publication of this summons, and in case of your failure to do so, for want thereof, Plaintiff will apply to the court for the relief demanded in the Complaint to Quiet Title.
Plaintiff is the fee simple owner of the real property in Jackson County, Oregon particularly described as follows:
"all that piece or parcel of land situated in the Town of Ashland, Jackson County, State of Oregon, and known on the official maps of said Town as the Plaza and bounded by Blocks One, Two and Three, and the Ashland Flouring Mill lot," (the "Property"). The legal description to be read alongside the official map of the time, 1879. Of that part of the City of Ashland recorded on August 21, 1884, in the Jackson County Oregon Deed Records, Volume 11, Page 481 of the Deed Records of Jackson County, Oregon. Except therefrom; all public rights within the right of ways of the original East Main Street and 20 East Main Street.
The real property described above is not in the actual possession of any person other than Plaintiff. Defendants claim some interest adverse to Plaintiffs in the real property or any portion thereof. Plaintiff has no plain, speedy, or adequate remedy at law.
NOTICE TO DEFENDANT(S): READ THESE PAPERS CAREFULLY! You must "appear" in this case, or the other side will win automatically. To "appear" you must file with the court a legal document called a "motion" or "answer." The "motion" or "answer" must be given to the court clerk or administrator within 30 days along with the required filing fee.
